Violations of special types of military service: questions of criminal liability.

Crimes against the order of incurring special services are: violation of the rules of combat duty (combat service) (Art. 340 of the Criminal Code); violation of the rules for bearing frontier service (Art. 341 of the Criminal Code); violations of regulations for guard (Watchkeeping) services (Art. 342 of the Criminal Code); violation of the rules of service for the protection of public order and public security (Art. 343 of the Criminal Code); breaches of the rules on implementing internal service and patrol in Garrison (Art. 344 of the Criminal Code).

Legal regulation of special types of military service is intended to ensure duty tasks forces and equipment in peacetime and wartime, and includes both the regulation of the order of their objection, and the responsibility for their violation. Establishing criminal responsibility for violation of the order and the rules for bearing special types of military service is determined by the need to reflect the increased social danger of such violations.

Military legal science does not have the necessary level of special studies in which a sufficiently high scientific and theoretical level, the legal aspects of liability for violation of the rules on implementing and special types of military service, and therefore the scientists are continuing research in this area. Many important problems of legal regulation of the life and work of the military, members of the rescue forces and resources, not sufficiently addressed in the scientific literature. These should include, for example, the question of criminal liability for violation of military duty to protect public order and public security, for violating the rules of combat duty, etc.
