Objective 1
JSC Trading House "Children's World" addressed to the Khabarovsk Regional Court a statement challenging the legality of Khabarovsk Krai Legislative Duma "About sales tax" that violates the property rights of a legal entity. The definition of the Khabarovsk regional court to accept the complaint was denied due to the fact that the Act is not a normative act as cover the definable range of businesses. In the definition of the judges also contained a reference to jurisdiction over the complaint to the arbitral tribunal. JSC Trading House "Children's World" redirected requirement invalidation of the above law to the Arbitration Court of Khabarovsk Territory. The case was considered by the arbitral tribunal on the merits, in the reasoning of the decision in the case was, in particular, reads: "The arbitral tribunal considers to be required to specify the Khabarovsk Regional Court on the jurisdiction of the case to the arbitral tribunal, as the dispute between the courts of different branches of the judiciary over jurisdiction civil cases are not allowed ... ".
